| The request for arbitration must be presented to the SG of CAM and contain, at least, the information of article 6.3 of CAM Rules of Arbitration. |
Each request for arbitration presented under CAM Rules of Arbitration must be accompanied by an advance payment on the administrative expenses of CAM, for the amount of $16,000.00 M.N. plus I.V.A. tax. |
| Once the number of copies referred to in article 3 have been received, and the advance payment has been effectuated, the SG shall send the request to the respondent and fix a term of 30 days to answer the request. |
| Within 30 days from the receipt of the request from the SG, the respondent shall file an answer which shall contain, at least, the information of article 9.1 of CAM Rules of Arbitration. In case of a counterclaim, it shall contain the same information as the request. |
| The claimant must file a reply to the counterclaim within 15 days from the date of receiving it. |
| If the General Council shall not decide anything concerning the existence, validity or scope of the arbitration agreement, neither anything concerning the constitution of the arbitral tribunal, the SG shall confirm the arbitrators, as long as they have submitted a statement of independence without reserves or with reserves that have not provoked any objection by the parties. |
| The SG shall fix the amount of the deposit to cover the arbitration expenses pursuant to the Scale of Arbitration Expenses established in Appendix II. The deposit is destined to cover the arbitration expenses, which include the administrative expenses of CAM, as well as the arbitral tribunal fees. In this stage of the proceeding, the SG shall subject the transmission of the file to the arbitral tribunal to the payment of 50% of the deposit (25% each party). |
| The file of the case is sent to the arbitral tribunal once it has been appointed, and half of the deposit covered (50%). |
| The Terms of Reference is a document which resumes the conflict and establishes the claims and pleas of the parties. Within 30 days of the date of receipt of the file, the arbitral tribunal shall draw up this document, which shall contain the information referred to in article 24.1 of the Rules. In this stage of the proceeding, the arbitral tribunal shall establish a provisional procedural calendar in order to conduct the proceeding, and will notify it to the parties and the SG. |
| Once the Terms of Reference has been signed or approved, the parties shall pay the balance of the deposit to cover the arbitration expenses (25% each party). The arbitration proceeding will be suspended until the balance of the deposit be covered. |
When a hearing is to be held, the arbitral tribunal shall summon the parties to appear before it indicating the place, day and time, informing the SG of the same. |
| The arbitral tribunal shall declare the proceedings closed once the parties have had a reasonable opportunity to produce their evidence and make their arguments, and will write the draft award. |
| The General Council shall examine the award. The GC may lay down modifications as to the form and, without affecting the arbitral tribunal´s liberty of decision, may also draw its attention to points of substance. |
| Once the award has been approved by the General Council, the arbitral tribunal shall sign the award, which will be notified to the parties by the Secretary General. |
| Within 15 days of the reception of the award, a party may make an application to the SG to request the arbitral tribunal to make a correction of any clerical or computational error, or of similar nature contained in the award. |
